The Texas Legislature has adopted several statutes to encourage the use of Alternative Dispute Resolution to resolve divorce proceedings. The purpose of these statutes is to decrease cost and animosity that can be created during divorce proceedings. Mediation may be employed to resolve the dissolution of a marriage either by agreement between the parties or by the court. A mediated settlement agreement will be binding on the parties if the agreement: * sets forth that it is not subject to revocation. * signed by both parties. * signed by the parties? attorneys who were both present when the agreement was signed.
